TERMS AND CONDITIONS OF SALE

Article 1 – Scope of Application
These Terms and Conditions of Sale (“T&Cs”) apply to all orders placed on the website klytia.paris, operated under the brand KLYTIA.
By placing an order, the customer acknowledges having read and accepted these T&Cs without reservation.
Article 2 – Products
The products offered for sale comply with applicable French and European legislation.
Product descriptions, images and visuals are provided for information purposes only and are non-contractual.
KLYTIA reserves the right to modify its product range at any time.
Article 3 – Prices and Additional Charges
Prices are displayed in euros (€), all taxes included (TTC), excluding any customs duties or import taxes.
For orders shipped outside the European Union, any customs duties, local taxes or import fees are the sole responsibility of the customer and may not under any circumstances be claimed from KLYTIA.
Article 4 – Orders and Customer Commitment
Any validated order constitutes a firm and final commitment from the customer.
KLYTIA reserves the right to refuse or cancel any order in the event of:

a previous dispute with the customer,
-
suspicion of fraud, abuse, or bad faith behavior.
Article 5 – Payment
Payment is due immediately upon ordering.
No order will be shipped until full payment has been confirmed.
Article 6 – Delivery
6.1 Delivery within France

Free shipping for all deliveries within France.

Delivery times are provided for information purposes only.
👉 Delivery delays shall not constitute a valid reason for order cancellation or refund, as long as the parcel is in transit.
6.2 International Delivery
KLYTIA shall not be held liable for delivery delays caused by:
-
postal services or carriers,
-
customs clearance procedures,
-
strikes, weather conditions,
-
or any event considered force majeure.
👉 No refund or cancellation shall be granted due to international delivery delays.
Article 7 – Lost, Blocked or Non-Received Parcels
A parcel is considered lost only after written confirmation from the carrier.
Mandatory procedure:

The customer must contact KLYTIA within 48 hours after the estimated delivery date.

A carrier investigation will be systematically initiated.

No refund or reshipment will be issued before the official closure of the investigation.
👉 Any false declaration of non-receipt constitutes fraudulent behavior, which may result in:

refusal of refund or replacement,
-
permanent suspension of the customer account,
-
legal action if necessary.
Article 8 – Right of Withdrawal (EU Customers)
In accordance with EU consumer law, customers have 14 days from receipt of the order to exercise their right of withdrawal.
Strict return conditions:

Products must be new, unused, unopened,
-
Returned in their original, intact packaging,
-
Free from any sign of use, opening or alteration.
👉 Any non-compliant return will be refused and will not be refunded.
Article 9 – Return Costs and Liability

Return shipping costs are entirely borne by the customer, in France and internationally.

Returns are made at the customer’s own risk.

KLYTIA cannot be held responsible for loss or damage during return shipping.
Article 10 – Exclusion of the Right of Withdrawal
For hygiene and consumer protection reasons, products that have been opened, used or unsealed are neither returnable nor refundable, in accordance with Article L221-28 of the French Consumer Code.
Article 11 – Limitation of Liability
KLYTIA shall not be held liable for:

improper or non-compliant use of products,
-
indirect or consequential damages,
-
abusive or fraudulent customer behavior.
In all cases, KLYTIA’s liability shall be strictly limited to the amount of the order concerned.
Article 12 – Force Majeure
KLYTIA shall not be held liable for failure or delay in performance due to force majeure events as defined by French case law (pandemic, strikes, natural disasters, logistics disruptions, etc.).
Article 13 – Personal Data
Personal data is processed in compliance with the GDPR and applicable regulations.
Customers may exercise their rights in accordance with the Privacy Policy available on klytia.paris.
Article 14 – Governing Law and Disputes
These T&Cs are governed by French law.
In the event of a dispute, an amicable solution shall be sought prior to any legal action.
Failing that, French courts shall have exclusive jurisdiction.
